NITV
Prevails In Copyright
Infringement Litigation
Against Flood and
Ryan
After a
protracted legal battle, the
U.S. Federal Court for the
Southern District of Florida
has found that the Global
Voice Stress Analyzer (GVSA)
is an infringement on the
Computer Voice Stress
Analyzer™ (CVSA®).
The Court found that the
GVSA is a copy of the CVSA
software and that
John Ryan
of Australia;
Patrick Flood,
a former NITV instructor
from California;
International Truth
Verification Systems Pty
Ltd. (ITVS); and
Final
Analysis, LLC are
guilty of copyright
infringement. A
permanent injunction has
been issued against Ryan,
Flood, their entities, and
their agents to prevent them
from selling the GVSA or any
other infringing version of
it in the United States.
They were also found guilty
of Trademark infringement.
Because of
the finding and injunction
by the federal court, any
agency that purchased or
acquired the GVSA, or any
version of it, is required
to surrender that system to
the NITV as it has been
found to contain software
that is a pirated version of
the CVSA in violation of US
and international copyright
laws.
Additionally, the court
specifically prohibited
Flood and
Ryan and anyone
working in active concert
with either of them “from
using CVSA or any colorable
imitation thereof, such as
the acronym GVSA, or any
word or term which is
confusingly similar
thereto.”
The NITV has
spent more than 20 years and
considerable resources
developing the CVSA and
takes copyright infringement
and theft of its
intellectual property very seriously. The NITV
will continue to
aggressively defend our
intellectual property,
regardless of the cost.
